January 14, 2014 Minutes

The January 14, 2014 meeting of the Honorable Clay County Board was called to order at 6:00 p.m. by Sheriff Andy Myers.
The Pledge to the flag was led by Sheriff Myers.
The blessing was led by Brad Harris.
The roll was called: Present: Mike Spitzner,Brad Harris, Jerry Britton, Janice Brooks, Thomas Butcher, John Weidner, Chris Rinehart, Bryan Knapp, Ted Whitehead,  Ron
King, David Johnson, and Mary McCollough
Absent: Sue Pettit and Mike Rinehart
Vice Chairman Britton acknowledged guests and there were no agenda changes.
Motion by Bryan Knapp, second by  Tom Butcher, to approve the County Board minutes of  December 10, 2013. Motion Carried. Voice Action
Motion by  Brad Harris, seconded by  Ted Whitehead to approve the action of the Claims Committee. Motion Carried.
Jennifer Brown , 911 Coordinator, presented the 911 Report in written form.
Jeff Workman, Clay County Health Department, presented the Board of Health Report in written form, Workman reported that the Flu is widespread and they are working to get more vaccine on hand:  Workman also addressed questions on Septic Systems regulations, and also the hospice program.
Sheriff Andy Myers presented the Sheriff’s Department Report in written form.  Myers expressed his appreciation to the Highway Department, Township Road Commissioners  and area farmers for clearing snow packed roads last week.
Sheriff Myers reported on leaks in the Courthouse roof, discovered after the recent heavy snows.  Myers noted that interior issues were being addressed and Myers is focusing on getting estimates for roof repairs.  The matter was referred to the Executive Finance Committee and the Building and Grounds Committee.
Myerrs next item of business concerned the possible plans for an addition at the jail.  Myers confirmed with the board that they have budgeted  $300,000 for an addition of office space for the jail.  The board asked Myers to do his due diligence in the planning and bidding process, and bring it back before the board.
Motion by Tom Butcher, Seconded by Ted Whitehead to go to closed session Time: 6:30 PM,  for the following purpose: (2) Collective negotiating matters between the public body and its employees or their representatives, or deliberations concerning salary schedules for one or more classes of employees (5 ILCS 120/2 (c) (2);. Motion Carried. Voice Action
Motion by  Ron King, Seconded by Chris Rinehart to return to open session. Time 6:45 PM. Motion Carried. Voice Action
No action was taken by the board upon return to open session.
The Probation Departments Report was available in written form.
Circuit Clerk Crystal Ballard presented her report in written form.
Motion by Bryan Knapp, Seconded by Ted Whitehead to approve a Resolution to rescind the November 9, 2010 Resolution regarding E- Citation Fees, thus allowing for the collection of additional fees. Motion Carried
RESOLUTION
WHEREAS,  by means of a Resolution passed and approved on November 9, 2010,, by the Clay County Board, it was determined that no E-citation fees would be collected by the Clay County Circuit Clerk until more research had been conducted; and,
WHEREAS,  the Circuit Court Clerk of Clay County and the Clay County Board have determined that they wish to rescind the Resolution of November 9, 2010 regarding the collection of E- citation fees.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF CLAY COUNTY, ILLINOIS  That  the Resolution entered on November 9, 2010 is hereby rescinded.

Motion by Brad Harris, Seconded by Mary McCollough to approve a Resolution for the mailing fee increase for the Circuit Clerk. Motion Carried
RESOLUTION
WHEREAS,  by means of a Resolution passed and approved on August  12,2003,  by the Clay County Board, it was determined that the fee would be collected by the Clay County Circuit Clerk when the Clerk is required to mail, would be $500 plus the cost of postage; and,
WHEREAS,  Chapter 705, Act 105, Section 27.1a(h) provides that in all counties having a high population of not more that 500,000 inhabitants, in civil cases, that when the clerk is required to mail, the fee will be a minimum of $2.00 and  a maximum of $10.00, plus the cost of postage.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF CLAY COUNTY, ILLINOIS  that  the  mailing  fee to be assessed by the Circuit Clerk for mailings in civil cases shall be and in hereby increased to $10.00.

Treasurer Jana Tolliver presented  the Treasurer Department Reports in written form.  Additionally, Tolliver updated the board on the status of State Reimbursements.
Tolliver then presented the Zimdars A/C and Appliance bill for the furnace and A/C installation at the Probation office as a capital expenditure request.
Motion by Tom Butcher, Seconded by  Chris Rinehart to approve the total Zimdars billing from Capital Expenditure Fund.  Motion Carried.
Motion by Bryan Knapp, Seconded by  Tom Butcher, that the Chairwoman of the County Board be authorized to execute the Local Agency Agreement (BLR 05310) with the
State of Illinois, acting by and through its Department of Transportation, for the preliminary engineering cost for the Porter Bridge on TR-89 (Structure #013-3158 in Blair Township, Sec. 12-02117-00-BR. Motion Carried
Motion by Brad Harris, which was seconded by Mike Spitzner, that the Chairwoman of the County Board be authorized to execute all documents necessary to enter into an agreement with Rhutasel & Associates, Inc. of Centralia, Illinois for the performance of preliminary engineering services for the construction of Porter Bridge over Panther Creek on Blair TR89 (Finch Lane), Section 12-02117-00-BR, at a fee of $29,850.00.  Motion Carried.
Motion by Ted Whitehead , which was seconded by Bryan Knapp, to rescind Bridge Aid Petition 09(05-2) in Hoosier Township.   Motion  Carried. Voice Action.
Motion by Dave Johnson, which was seconded by Ron King, to approve Bridge Aid Petition 14(05-1) in Hoosier Township.  Motion  Carried.
Motion by Tom Butcher, which was seconded by Mike Spitzner, that the Chairwoman of the County Board be authorized to execute the Local Agency Agreement (BLR 05310) with the State of Illinois, acting by and through its Department of Transportation, for construction and construction engineering costs for the Bridge on TR-280 (Structure #013-3107) in Hoosier Township, Sec 09-05103-00-BR. Motion Carried.

The ROE #12 Draft Financial Statement was presented and is on file in the County Clerk’s Office for review.
