The June 10, 2014 meeting of the Honorable Clay County Board was called to order at 6:00 p.m. by Sheriff Andy Myers.

Board Member Mike Rinehart stated he felt other board members should have an opportunity to attend other committee meetings, even though there is a policy of not being paid for attending non- member committee meetings.
Chairman Pettit agreed with the idea of attending any meetings they can and that rotating membership on committees was helpful. Committee meetings are open to the public.
Additionally, Rinehart noted that Employee Time Sheets and Closed Session Minutes will be reviewed in July, date to be determined.
County Clerk Brenda Britton presented the County Clerk Semi Annual Report in written form.

Chairman Pettit presented the 911 Report in written form.
Jeff Workman, Clay County Health Department presented the Board of Health Report in written form. Additionally, Workman is working to schedule an Open Meeting Act/FOIA Training within the next couple of months.
Sheriff Andy Myers presented his department report in written form.
Myers also reported that repairs had been made to the east side of the Courthouse roof and the company will come back to inspect for leaks.
Before moving on to the next agenda item, Board Member Mike Rinehart addressed the board with some concerns he has regarding property exchange, citing 65 ILCS. Rinehart was questioning whether the County had held a Public Hearing prior to the transfer of ground. Consensus was that a public hearing has not been held.
The board briefly discussed the transfer of property and the pending sale of property. The approval of the sale of county owned property will be tabled, pending review by the State’s Attorney.
Board Member Mike Rinehart also stated he had filed a Request for Review with the Attorney General’s office regarding the March 27, 2014 Special Board Meeting.

ADMINISTRATIVE ORDER NO. 2014-6
WHEREAS, the Circuit Judges of the Fourth Judicial Circuit clerk have appointed Christopher S. Elliott as Public Defender of Clay County, for the period from July 1, 2014, through June 30,2015; and
WHEREAS, the Chief Judge has administrative authority to establish the terms and conditions under which the Public Defender shall perform his duties of office.
WHEREFORE, IT IS ORDERED, that the terms and conditions under which the Public Defender in Clay County shall perform his duties of office are as follows:
I. DESCRIPTION OF SERVICES
A.) The Public Defender shall represent those individuals who are designated by the Court to receive the services of the Public Defender’s Office of Clay County pursuant to 55 ILCS 5/3- 4006. The Public Defender shall be available at all times that court is in session in Clay County. Should a conflict of interest in representation of a defendant arise, the Public Defender’s Office shall petition the court to withdraw from said representation.
B.) The Public Defender is employed in a full- time capacity and shall not engage in private practice. The Public Defender shall comply with normal office hours which the courthouse is open and as followed by other county employees. Its is understood that the Public Defender must investigate cases, perform legal research, visit incarcerated prisoners, and perform other responsibilities of the position that may require work outside the court and , at times, beyond normal office hours. It is understood that the Public Defender will be available at all times as required by the court in the exercise of duties.
II. TERM AND TERMINATION
A.) The term of this Order shall be from July 1, 2014, through June 30, 2015. It is further provided that this Order shall be subject to termination upon cancellation of the appointment by a majority of the Circuit Judges of the Fourth Judicial Circuit with or without cause. Upon termination or cancellation, all rights and duties of the Public Defender and of Clay County under this Order shall cease to exist. The public Defender shall have the right to terminate his or her appointment upon 60 days notice to both the Chief Judge and the Chairman of the County Board.
B.) The Public Defender must apply for reappointment by written notification to the Chief Judge of the Fourth Judicial Circuit and to the Circuit Judges residing in Clay County at least 90 days prior to the termination of this Order. In the event the Public Defender is reappointed, such renewal shall be for a period of one year.
III. COMPENSATION AND EXPENSES
A.) For the purpose of compensation, the Public Defender of Clay County shall be considered to be a full-time employee of Clay County at a salary of $116,063.10 per year, payable as determined by Clay County. This salary represents not less than 90% of the county’s State’s Attorney’s annual salary and is contingent upon the State of Illinois paying 66 2/3% of this annual Public Defender salary as set forth in 55 ILCS 5/3-4007. In the event the state does not pay that amount, then the Public Defender will be on a contract basis at the rate of $36,000 per year. If at any time during the year the funding runs out, the Public Defender will be on part-time basis at a rate of $3000 per month with no health insurance.
B.) In the event the Public Defender deems it necessary to employ the services of a private investigator, licensed physician, psychologist, psychiatrist, or other expert witness during the course of representation of persons pursuant to the Order, the Public Defender must first apply to the Circuit Court for approval of such employment be written motion in said case with to the State and can employ such persons only after judicial approval is obtained. After such approval is obtained, the Public Defender shall not be liable for payment of such services or expenses related directly thereto, but payment, pursuant to submission of a proper bill, voucher and Order of the Circuit Court, shall be made by Clay County.
C.) Clerical and office expense incurred shall be in accordance with the budget appropriation approved by the Clay County Board.
IV. OUTSIDE SERVICES
A.) The Order and payment hereunder does not encompass appointments by the Court for representation of defendants remanded to the Illinois Department of Corrections or to a similar correctional institution for the purpose of proceedings of the following nature.
I. Pursuit of appeals beyond the perfecting of appeal; by preparation and filing of Notice of Appeal, Docketing Statement, and related Notices in cases where the State Appellate Defender prosecutes the appeal.
ii. Pursuit of any federal remedy of post- conviction or civil rights nature.

Construction Proposed: Remove existing structure and replace with 2-42” x 29” arch diameter pipe culverts with aggregate backfill.
Type of Traffic: Farm to market. This is a Motor Fuel Tax
Section (TR-91) and a necessary artery for traffic. It is both a school bus route and U.S. mail route.
The construction of the project shall be by the Clay County Highway Department, and per the resolution of the Clay County Board approved June 10, 2014
The division of costs are estimated as follows:
County (50%) Township (50%) Total
Construction $2,100.00 $2,100.00 $4,200.00
A portion of the County’s share of the project will be provided by in-house labor and equipment rental costs.

FIRST AMENDMENT TO MANAGEMENT AGREEMENT
GOOD SAMARITAN REGIONAL HEALTH CENTER AND
CLAY COUNTY HOSPITAL AND CLAY COUNTY, ILLINOIS
This FIRST AMENDMENT TO MANAGEMENT AGREEMENT (“Amendment”) is effective June____, 2014 (“Effective Date”) by and between Good Samaritan Regional Health Center, a Missouri nonprofit corporation, (“ANAGER”) and Clay County, Illinois (“OWNER”).
WHEREAS, ST Mary’s-Good Samaritan, Inc., HOPSITAL and OWNER entered into an Management Agreement dated November 21, 2013 (“Agreement”);
WHEREAS, ST Mary’s-Good Samaritan, Inc. was listed as the contracting entity (referred to in the Agreement as “MANAGER” in the Agreement;
WHEREAS, MANAGER, HOSPITAL, and OWNER intended for Good Samaritan Regional Health Center to be listed as “MANAGER” in the Agreement;
WHEREAS, ST Mary’s-Good Samaritan, Inc. is not an entity that can perform the obligations listed in the Agreement;
WHEREAS, Good Samaritan Regional Health Center desires to assume all the obligations and responsibilies of the Agreement and is an entity under common control of St. Mary’s- Good Samaritan, Inc.; and
WHEREAS, HOSPITAL, OWNER, and MANAGER desire to modify certain provisions of the Agreement as set forth below in order that the Agreement, as modified, is acceptable to both parties.
THEREFORE, it is understood and agreed upon by the parties as follows:
- The MANAGER’s contacting entity was mistakenly listed as ST. Mary’s-Good Samaritan, Inc., when it should have been listed as Good Samaritan Regional Health Center, a Missouri nonprofit corporation.
All other terms of the Agreement shall remain in full force and effect. If the terms of the Agreement in any way
conflicts with or are otherwise inconsistent with the terms of this Amendment, this Amendment shall govern and control.
