March 12, 2013 Minutes

The March 12, 2013 meeting of the Honorable Clay County Board was called to order at 6:00 p.m. by Sheriff Sulsberger.

The Pledge to the flag was led by Sheriff Sulsberger.

The blessing was led by Brad Harris.

The roll was called: Present: Mike Spitzner, Brad Harris, Jerry Britton, Janice Brooks, Thomas Butcher, Chris Rinehart, Bryan Knapp, Ron King, Mike Rinehart and Jesse James. Absent: Vernon Guinn, Ted Whitehead, Joe Rudolphi and Sue Pettit.

Vice Chairman Jerry Britton acknowledged guests and there where no agenda changes.

Motion by Brad Harris, second by Tom Butcher, to approve the County Board minutes of February 12, 2013. Motion Carried. Voice Action.

Motion by Mike Rinehart, seconded by Brad Harris, to approve the action of the Claims Committee. Motion Carried.

Motion by Mike Rinehart, seconded by Janice Brooks, to approve the review of the Employee Time Sheets and review of the Closed Session Minutes, as submitted. Motion Carried.

Rachelle Hollinshead, County Extension Director, appeared before the board in recognition of Local Government Week. Rachelle presented information to the board University of Illinois Extension Services.

Jeff Workman, Clay County Health Department reported that the Board of Health report will be distributed tomorrow.

County Treasurer Jana Tolliver presented the Treasurer’s Monthly Reports in written form.

Sheriff Jim Sulsberger presented his department report in written form.

County Engineer Mike Quandt presented the Highway Department report in written form.

Motion by Tom Butcher, seconded by Ron King, engage the legal firm Hinshaw & Culbertson to provide legal services pertaining to SSM negotiations. Motion Carried. 9 Yes 1 Abstain ( Mike Rinehart )

Motion by Jesse James, seconded by Bryan Knapp, engage CBIZ to perform a valuation pertaining to SSM negotiations at an estimated cost of $15,000-$20,000. Motion Carried. 9 Yes 1 Abstain ( Mike Rinehart )

Motion by Tom Butcher, seconded by Jesse James, to approve the change to the Medical Staff Bylaws as presented. Motion Carried. Voice Action.

Jon Ashby, Leymone Hardcastle CPA, presented the FY 2012 Clay County Audit. Ashby noted the County was given a clear opinion for its modified cash basis system of accounting.

Executive Finance Committee Chairman Tom Butcher, updated the board on Public Safety Tax Requests from Fire Protection Districts. The board has set aside $17,500 in the current budget of Safety Tax Money. Requests will be received until the end of the month and referred to Executive Finance Committee. Additionally, Butcher noted the board is still negotiating with the FOP & Teamsters Unions.

Motion by Tom Butcher, seconded by Jesse James, to ratify the chairman’s appointment of Robert Briscoe to the Harter-Stanford FPD for a three year term ending May 2016. Motion Carried. Voice Action.

Motion by Mike Rinehart, seconded by Chris Rinehart, to ratify the Chairman’s appointment of Laren Erwin to the North Clay FPD for a three year term ending May, 2016. Motion Carried. Voice Action.

Motion by Janice Brooks, seconded by Tom Butcher, to ratify the Chairman’s appointment to Robert Simpson to the Clay City FPD for a three year term ending May 2016. Motion Carried. Voice Action.

Motion by Mike Spitzner, seconded by Ron King, to ratify the chairman’s appointment of Kevin Henry to the Clay City FPD for a three year term ending May 2016. Motion Carried. Voice Action.

Vice Chairman Jerry Britton read a thank you note from the Whitehead family after the loss of Bruce Whitehead.

Vice Chairman Britton declared a vacancy in office in District K upon the resignation of Vernon Guinn.

DECLARATION AND NOTICE OF VACANCY IN OFFICE

In accordance with the provisions of Chapter 10, Act 5, Section 25-11 of the Illinois Compiled Statutes, the County Board of Clay County, Illinois, a county which is not a home rule unit, hereby declares that a vacancy exists in the office of County Board Member of District K, due to the resignation Vernon Guinn.

The County Clerk is hereby directed to give a written notice to the county central committee of each established political party of such vacancy by providing each committee with a copy of this Declaration and Notice of Vacancy in Office.

Notice is hereby further given that such vacancy shall be filled within 60 days by appointment of the Chariman of the County Board with the advice of the County Board, in accordance with the statutory requirements.

Vice Chairman Britton noted that next month’s meeting will be held on Thursday, April 11 due to the April 9th Consolidated Election.

Board Member Chris Rinehart noted that the Building and Grounds Committee will meet Thursday, March 21, 2013 at 6:00 p.m., to discuss the planting on the courthouse law.

Board Member Mike Rinehart reported on a recent Solid Waste Committee meeting.

Sheriff Sulsberger reported he and Chief Deputy French had recently met with the Union Attorney to discuss labor negotiations for the FOP.

Probation Officer Curtis Leib is currently recovering from recent surgery. The Probation Report was distributed to County Board Members.

County Clerk Britton noted that, due to the resignation of Kathy Smith , Kellie Fore has been hired in the County Clerk’s Office. The position was posted on the website for 2 weeks prior.
