November 12, 2013 Minutes

The November 12, 2013 meeting of the Honorable Clay County Board was called to order at 6:00 p.m. by Sheriff Andy Myers.
The Pledge to the flag was led by Sheriff Myers.
The blessing was led by Brad Harris.
The roll was called: Present: Sue Pettit, Chairman, Mike Spitzner,Brad Harris, Jerry Britton, Thomas Butcher, John Weidner, Chris Rinehart, Bryan Knapp, Ted Whitehead,  Ron King, David Johnson, and Mike Rinehart.
Absent: Janice Brooks
Chairman Sue Pettit acknowledged guests and made one agenda change: under the Sheriff’s report for reviewing the fuel bids for possible approval.
Motion by Tom Butcher, second by Mike Spitzner, to approve the County Board minutes of  October 8, 2013. Motion Carried. Voice Action.
Motion by  Mike Rinehart,  seconded by  Brad Harris  to approve the action of the Claims Committee. Motion Carried.
Chairman  Pettit presented the 911 report in written form.
There was no Board of Health Report available for presentation.
Sheriff Andy Myers presented his report in written form.
Sheriff Myers updated the board on a vehicle purchase.  Myers had previously received board approval to purchase an Explorer and has been waiting 10 weeks for delivery.  With this turn of events, Myers requested that the board allow him to substitute another vehicle purchase before the end of the current fiscal year.
Motion by Brad Harris, Seconded by Chris Rinehart to allow Sheriff Myers to substitute the purchase of a Ford Explorer, previously approved, for another similar vehicle, as available. Motion Carried.
Sheriff Myers gave an update on repairs to the Probation building. Servpro has been working to dry out the basement.  Myers has checked with Zimdars about replacing the heating/ cooling systems, approximate cost $13000.
Additionally, Myers has spoken with Engineer Quandt regarding the lots and grading issues at Probation.  Sheriff Myers approximates costs for grading/ concrete work to run $5000.
The Servpro bill for drying out the basement, mold/ remediation is $9,469.52.  Budgeting issues for the incurred and expected cost for repairs was referred to the executive  finance  committee.
Motion by Brad Harris , Seconded by Ted Whithead, to approve the Fire Alarm Contract with F.E.Morgan. Motion Carried.
Sheriff Myers reported that he had received bids back to award for fuel for December 1, 2013 to November 30,2014.  Since this was not an agenda item, the board consensus was to table action on awarding bids until the December Meeting.
Probation Officer Curtis Leib presented  the Probation Department report in written form.
Judge Todd addressed the board, thanking them for financial assistance in the renovations to the downstairs courtroom.  Judge Todd praised Circuit Clerk Ballard on her efforts to coordinate the construction/ refurbishment project.

Treasurer Jana Tolliver presented  the financial reports in written form.  Tolliver reported that the 2nd tax distribution has been completed, $10,901,272,13.
Motion by Chris Rinehart Seconded by Tom Butcher, to adopt the 2014 Motor Fuel Tax Maintenance Resolution (BLR 14220) in the amount of Three Hundred
Thousand and 00/100 Dollars ($300,000.00). Motion Carried. Voice Action.

RESOLVED, by the County board                    Clay                                                 County, that   $300,000.00
Is appropriated from the Motor Fuel Tax allotment for the maintenance on county or State highways and meeting the requirements of the Illinois Highway Code, and be it further
RESOLVED, that maintenance sections or patrols be maintained under the provision of said Illinois Highway Code beginning                January 1, 2014                and ending                December 31, 2014                     and be it further
RESOLVED, that the County Engineer/ County Superintendent of Highways shall, as soon as practicable after the close of the period as given above, submit to the Department of Transportation, on forms furnished by said Department, a certified  statement showing expenditures from and balances remaining in funds authorized
for expenditure by said Department under this appropriation, and be it further
RESOLVED, that the County Clerk is hereby directed to transmit two certified copies of this resolution to the district office of the Department of Transportation.

Motion by Jerry Britton, Seconded by  Tom Butcher to approve the Resolution for the States Attorney Appellate Prosecutor.
RESOLUTION
WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor was created to provide services to State’s Attorneys in Counties containing less than 3,000,000 inhabitants; and
WHEREAS, the power and duties of the Office of the State’s Attorneys Appellate Prosecutor are defined and enumerated in the “State’s Attorneys Appellate Prosecutor’s Act”, 725 ILCS 210/1 et seq., as amended; and
WHEREAS, the Illinois General Assembly appropriates monies for the ordinary and contingent expenses of the Office of the State’s Attorneys Appellate Prosecutor, one-third from the State’s Attorneys Appellate Procutor’s County Fund and two thirds from the General Revenue Fund, provided that such funding receives approval and support from the respective Counties eligible to apply; and
WHEREAS, the Office of the State’s Attorney Appellate Prosecutor and the Illinois General Assembly have reviewed and approved  a budget for Fiscal Year 2014, which funds will provide for the continues operation of the Office of the State’s Attorney Appellate Prosector.
NOW, THEREFORE, BE IT RESOLVED that the Clay County Board, in regular session,          Day of                    , 20            does hereby support the continued operation of the Office of the State’s Attorneys Appellate Prosecutor, and designates the
Office of the State’s Attorney’s Appellate Prosecutor as its Agent to administer the operation of the appellate offices and process said appellate court cases for this County.
BE IT FURTHER RESOLVED that the attorneys employed by the office of the State’s Attorneys Appellate Prosecutor are hereby authorized to act as Assistant State’s Attorneys on behalf of the State’s Attorney of this County in the appeal of all cases, when requested to do so by the State’s Attorney, and with the advice and consent of the State’s Attorney prepare, file and argue appellate briefs for those cases; and also, as may be requested by the State’s Attorney, to assist in the prosecution of cases under the Illinois Controlled Substances Act, the Cannabis Control Act, the Drug Asset Forfeiture Procedure Act and the narcotics Profit Forfeiture Act.  Such attorneys are further authorized to assist the State’s Attorney in the State’s Attorney’s duties under the Illinois Public Labor Relations Act, including negotiations thereunder, as well as in the trial and appeal of tax objections.
BE IT FURTHER RESOLVED that the Office of the State’s Attorneys Appellate Prosecutor will offer Continuing Legal Education training programs to the State’s Attorneys and Assistant State’s Attorneys.
BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor may also assist the State’s Attorney of this County in the discharge of the State’s Attorney’s duties in the prosecution and trail of other cases, and may act as Special Prosecutor if duty appointed to do so by a court having jurisdiction.
BE IT FURTHER RESOLVED that the Clay County Board hereby agrees ti participate in the service program of the Office Of the State’s Attorneys Appellate Prosecutor for Fiscal Year 2014, commencing December 1, 2013, and ending November 30, 2014, by hereby appropriating the sum of $5,000.00 as consideration for the express purpose of providing a portion of the funds required for financing the operation of the Office of the State’s Attorneys Appellate Prosecutor, and agrees to deliver the same at the Office of the State’s Attorneys Appellate Prosecutor on request during the Fiscal Year 2014.

Chairman Pettit announced Board Members invitation to the Courthouse Christmas Dinner on December 10,2013.
Additionally, Pettit reminded board members of a Mediation meeting for FOP on Wednesday, November 13, at 5:30pm at the Courthouse.
Sympathy was expressed to Brad Harris on the loss of his mother.  Brad thanked the board for the fresh flower memorial.

Motion by Chris Rinehart , Seconded by  Bryan Knapp to adopt the Special Tax For County  Highway Purposes Levy in the amount of $108,290.00, not to exceed  .0833 percent of its full, fair cash value. Motion Carried
Motion by Bryan Knapp , Seconded by  Dave Johnson to adopt the County Bridge Tax Levy in the amount of $65,000.00, not to exceed  .05 percent of its full, fair cash value. Motion Carried
