September 10, 2013 Minutes

The September 10, 2013 meeting of the Honorable Clay County Board was called to order at 6:00 p.m. By Sheriff Andy Myers.
The Pledge to the flag was led by Sheriff Myers.
The blessing was led by Ron King.
The roll was called: Present: Sue Pettit, Chairman, Mike Spitzner, Jerry Britton, Janice Brooks, Thomas Butcher, John Weidner, Chris Rinehart, Bryan Knapp, Ted Whitehead,  Ron King, David Johnson, and Mike Rinehart.
Absent: Brad Harris,  Jesse James
Chairman Sue Pettit acknowledged guests and made the following agenda changes: move the Circuit Clerk Crystal Ballard to report after Sheriff Andy Myers.
Motion by Tom Butcher, second by Ted Whitehead, to approve the County Board minutes of  August  13, 2013. Motion Carried. Voice Action.
Sheriff Andy Myers presented his Department Report in written form.  Additionally, Myers reported on Training his employees have recently completed.
Sheriff Myers presented the Jail Inspection Report in written form.
Motion by Jerry Britton,  Seconded by Tom Butcher  to go out for bids to sell the Sheriffs Departments 2005 Camper, 21 to 30 days, with right to refuse any and all bids. Motion Carried.
Motion by Mike Rinehart, Seconded by Chris Rinehart to approve the Sheriff’s recommendation to purchase a 2014 Ford Explorer AWD. With the trade in of a 2004 Impala and a 2013 Impala.  (Money has already been budgeted for this purchase.) Motion Carried.
Circuit Clerk Crystal Ballard presented her August report in written form.
Additionally, Ballard reported plans to renovate the Courtrooms, Law Library and Judge’s Chambers.
Motion by Janice Brooks, Seconded by Dave Johnson to approve, after review by the Executive Finance Committee, updating the Judge’s Chambers, Courtrooms, and Law
Library with carpet and paint, not to exceed $9500.00 (Funding to come from Miscellaneous and Contingencies). Motion Carried.
Motion by Mike Rinehart, Seconded by Ted Whitehead, to approve the action of the claims committee.  Motion Carried.
Additionally, Claims Committee Chairman Rinehart suggested considering the appointment of an alternate committee member to the Claims committee to ensure a quorom at the meetings.
Chairman Pettit presented the 911 report in written form.
Motion by Ron King, Seconded by  Bryan Knapp to approve moving Harter 6 and 7 polling facility to the Harter Township building. Motion Carried. Voice Action
Clerk Brenda Britton reminded Board Members that District H, E, J, K, N, C, I and an unexpired term for District F, will be up for nomination/ election in 2014.
Coroner Wes Miller presented his semi annual report in written form.
Jeff Workman, Clay County Health Department presented the Board of Health Report in written form.
Chairman Pettit noted that the Health Department will be proving Flu Shots to Board Members at the October 8, 2013 meeting.
The Probation Department report was presented  in written form to the board.
County Treasurer Jana Tolliver provided her reports in written form.  Additionally, Tolliver reported that they will soon be sending out the 2nd installment distributions. Tolliver also noted that Fire Protection Districts had been paid per previous board action as well as, schooling paid as per board action.
Motion by Jerry Britton, which was seconded by Tom Butcher to approve the Local Agency Agreement (BLR 05310) for preliminary engineering between Federal and County funds for the reimbursement of 80% of 2014 bridge inspection costs, Section 12-00088-00-BI, and that the Chairwoman of the County Board be authorized to execute the agreement. Motion Carried. Voice Action.
Motion by Jerry Britton, which was seconded by Chris Rinehart, to have the County Engineer apply for the Major Bridge Program for total replacement of the bridge over the Little Wabash River on Sailor Springs Road.  Motion Carried.  11 Yes, 1 Abstain
County Engineer Mike Quandt presented the Engineer’s Report in written form.  Additionally, Quandt reported he has finished with a cooperative agreement for work in Wayne County.
Motion by Tom Butcher, Seconded by Bryan Knapp to approve the request for additional user for the Flora Bank and Trust Shazam Program as presented.  Motion Carried. Voice Action
Motion by Jerry Britton, Seconded by Ron King to approve the purchase of the HMS Version 12 Software Upgrade at a total cost of $243,636.00.  Motion Carried.  11 Yes  1 Abstain
Clay County Hospital President Bob Sellers gave an update on SSM with a joint statement of both the Hospital Committee and SSM : After the completion of the due diligence, each party has respectively expressed an interest in pursuing a collaborative management agreement.  Under the management agreement, each party will continue to work toward a closer affiliation and the potential of a future purchase.

Hospital President  Bob Sellers announced that he had tendered his resignation to the Hospital Committee, effective October 4, 2013.  Sellers noted that the CEO at the Clay County Hospital provide leadership and felt there needed to be a change.  He has accepted another position with Optim Healthcare beginning October 7, 2013.
Hospital Committee Chairman Jerry Britton thanked Bob Sellers for stepping in during a difficult time at Clay County Hospital and thanked him for his professionalism and always having the best interest for our county foremost, noting our loss is their gain.
Chairman Pettit read a letter of resignation from Board Member Jesse James, who moved out of district, effective immediately.  Pettit then declared a vacancy in office for District N.
DECLARATION AND NOTICE OF VACANCY IN OFFICE
In accordance with the provisions of Chapter 10, Act 5, Section 25-11 of the Illinois Complied Statutes, the County Board of Clay County, Illinois, a county which is not a home rule unit, hereby declares that a vacancy exists in the office of County Board District N, due to the resignation of Jesse James, effective immediately.
The County Clerk is hereby directed to give a written notice to the county central committee of each established political party of such vacancy by providing each committee with a copy of this Declaration and Notice of Vacancy in Office.
Notice is hereby further given that such vacancy shall be filled within 60 days by appointment of the Chairman of the County Board with the advice of the County Board, in accordance with the statutory requirements.

Chairman Petitt reported on FOP negotiations noting that mediation has been scheduled for October 9, 2013, at 5:30, at the Courthouse.
Chairman Petitt presented the CEFS report in written form.
Executive Finance Committee Chairman Tom Butcher reported that Leymone Hardcastle will no longer be able to perform the audit for Clay County.  Butcher ask that the
Clerk and Treasurer make calls to surrounding counties for prospective audit firms, also directing a notice for bids be published.
Board Member Ted Whitehead stated that he echoed Jerry Britton’s Thanks to Bob Sellers for his service to the hospital, but also for his service with many civic organizations in our community.
