The March 27, 2014 meeting of the Honorable Clay County Board was called to order at 6:00 p.m. by Sheriff Andy Myers.
The Pledge to the flag was led by Sheriff Myers.
The blessing was led by Brad Harris.
The roll was called: Present: Sue Pettit, Chairman, Brad Harris, Jerry Britton, Janice Brooks, Thomas Butcher, John Weidner, Chris Rinehart, Ted Whitehead, Ron King, David Johnson, Mike Rinehart and Mary McCollough
Absent: Mike Spitzner and Bryan Knapp
Chairman Petitt acknowledged guests and asked about agenda changes. Board Member Mike Rinehart noted he had received a call from Dr. Lueking and that Dr. Lueking would like to make some remarks when the board goes into closed session.
Discussion ensued regarding what could be discussed and by whom during open/closed sessions.
Board Member Brad Harris asked about possibly amending the agenda other than how it was published/ posted.
Board Member Mike Rinehart then suggested discussing issues in closed session and then recessing the meeting and inviting other individuals back for comments in a reconvened meeting.
Rinehart reiterated that he wanted Dr. Lueking to be able to voice his concerns. At this point, States Attorney Brant stated she did not want to be in violation of OMA and advised that she didn’t think it would be appropriate in this executive session.
Motion by Janice Brooks, Seconded by Ron King to approve the agenda as it stands. Motion Carried. Voice Action. 11 Yes 1 No
Motion by Mike Rinehart Seconded by Brad Harris to go to closed session for the following purposes: (1) The appointment, employment, compensation, discipline, performance, of dismissal or specific employees of the public body (5ILCS 120/2 (c) (1); and (8) Litigation, when an action against, affecting or on behalf of the particular
body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent with the basis for such finding being: (5 ILCS 120/2 (c) (11); Time: 6:10 p.m. Motion Carried.
Motion by Mike Rinehart, Seconded by Ted Whitehead to return to open session. Time 6:25p.m. Motion Carried. Voice Action
